Pursuant to Bank Indonesia Regulation (PBI) No.13/20/PBI/2011, exporters are now required to receive all foreign exchange proceeds from exports (DHE) through domestic foreign exchange banks in Indonesia no later than 90 (ninety) days subsequent to the export notice (PEB). Specific to PEBissued in 2012, DHEwill mandatorily be received through domestic foreign exchange banks no later than 6 (six) months after the date of the PEB. Accordingly, DHEon PEBissued in January 2012 must have been received by July 2012.
Based on monitoring activities, hitherto, there remain exporters that still do not receive their foreign exchange export proceeds through domestic foreign exchange banks. Considering that sanctions against this type of violation commenceon 2nd July 2012, exporters could potentially face administrative sanctions in July consisting of a fine amounting to 0.5% of the nominal value of the DHEyet to be received through a foreign exchange bank. The fine can range from a minimum of Rp10,000,000 (ten million rupiah) to a maximum of Rp100,000,000 (one hundred million rupiah). Exporters failing to pay the administrative fine will have their export services suspended by the Directorate General of Customs.
Bank Indonesia has undertaken a number of socialization activities reaching out to exporters and relevant institutions across Indonesia and will continue to monitor compliance with the new regulation by exporters. In this context, exporters are reminded again to immediately channel all DHE through domestic foreign exchange banks within the predetermined timeframe.
Bank Indonesia would also like to emphasise that this regulation in no way limits or restricts exporters in terms of how they choose to utilise their foreign exchange proceeds from exports (DHE). Exporters are NOT obliged to convert their foreign exchange into rupiah nor hold their foreign exchange for a predetermined length of time at the domestic foreign exchange bank.
